These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Study Junkie ("Company," "we," "our," or "us") governing your access to and use of the Study Junkie website, platform, and services (collectively, the "Service").

Study Junkie is an AI-powered learning platform that allows users to:

  • Upload text-based materials (books, documents, PDFs, etc.)
  • Generate structured educational courses from uploaded materials using artificial intelligence
  • Access AI-generated lectures and assignments
  • Interact with an AI tutor for questions and guidance
  • Submit and receive feedback on assignments

The Service is provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time, with or without notice.

3. User Accounts

3.1 Account Registration

To access certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration

  • The material does not infringe upon any third party's intellectual property rights, including but not limited to copyrights, trademarks, or patents
  • The material complies with all applicable laws and regulations

4.2 Copyright and Intellectual Property Compliance

USER RESPONSIBILITY FOR COPYRIGHTED MATERIALS: Study Junkie does not verify, monitor, or take responsibility for the legality of materials uploaded by users. You assume full and sole responsibility for ensuring that any material you upload does not infringe on the intellectual property rights of others.

This includes, but is not limited to:

  • Books, e-books, or publications that you have not legally purchased or licensed
  • Pirated, illegally downloaded, or unauthorized copies of copyrighted materials
  • Materials shared without permission from the copyright holder
  • Content that violates Digital Millennium Copyright Act (DMCA) or similar laws

Study Junkie expressly disclaims any liability for copyright infringement or any other legal violations arising from user-uploaded materials. If you upload materials that you do not have the legal right to use, you do so at your own risk and may be subject to legal action by copyright holders.

4.3 Indemnification for Uploaded Content

You agree to indemnify, defend, and hold harmless Study Junkie, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Any material you upload to the Service
  • Any infringement of intellectual property rights resulting from your uploaded content
  • Any violation of applicable laws related to your use of the Service

4.4 License to User Content

By uploading content to the Service, you grant Study Junkie a limited, non-exclusive license to process, analyze, and store your content solely for the purpose of providing the Service to you. We do not claim ownership of your uploaded materials, and this license terminates when you delete your content or account.

5. Prohibited Uses

You agree not to use the Service to:

  • Upload any material that infringes on intellectual property rights of others
  • Upload illegal, harmful, threatening, abusive, harassing, defamatory, or objectionable content
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in any activity that interferes with or disrupts the Service

6. Intellectual Property Rights

6.2 AI-Generated Content

Courses, lectures, and other content generated by our AI based on your uploaded materials are provided to you for personal educational use. You may not redistribute, sell, or commercially exploit AI-generated content derived from copyrighted materials you do not own.

7. DMCA and Copyright Complaints

We respect the intellectual property rights of others. If you believe that any content on our Service infringes your copyright, please submit a DMCA takedown notice to us including:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing
  • Your contact information (address, phone number, email)
  • A statement that you have a good faith belief that use of the material is not authorized
  • A statement that the information in the notice is accurate
  • Your physical or electronic signature

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • AI-generated content will be free from errors or inaccuracies
  • Any defects in the Service will be corrected

The AI-generated educational content is provided for informational purposes only and should not be relied upon as a sole source of learning or professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUDY JUNKIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or use of our servers or your data
  • Damages resulting from user-uploaded content, including copyright infringement claims
  • Damages resulting from any content obtained from the Service
  • Damages resulting from interruption or cessation of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Study Junkie and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you upload or submit to the Service
  • Any claim that your uploaded content caused damage to a third party

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Study Junkie is registered, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Study Junkie regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Study Junkie.
